On May 14, 2024, the Council of the European Union adopted the Pact on Migration and Asylum.
 

This pact introduces a comprehensive reform of EU migration regulations, aiming to enhance and better coordinate the EU's strategies in the areas of migration, asylum, border management, and integration. The new provisions seek to establish effective measures for member states that, while more stringent than previous regulations, also aim to better guarantee the protection of human rights and European values. The pact’s provisions are specifically designed to:

 

  • Manage the flow of migrants in an orderly manner,
  • Create effective and uniform procedures, and
  • Ensure a fair distribution of responsibilities among member states.

 

By the end of 2024, every EU member state is required to draft an implementation plan for the EU Pact on Migration and Asylum. A significant reference for Poland’s plan is the recently adopted Polish Migration Strategy for 2025–2030, which has already sparked widespread controversy.

 

Given Poland’s upcoming deadline to submit its implementation plan and in light of the directions outlined in the “Strategy,” the Halina Nieć Legal Aid Center, along with a group of NGOs providing legal, integration, and humanitarian assistance to refugees and migrants, has developed a set of recommendations. These recommendations aim to ensure the effective protection of the rights of migrants and refugees in Poland.

 

The recommendations were prepared by:

 

The Migration Consortium, Amnesty International Poland, the Halina Nieć Legal Aid Center, the Helsinki Foundation for Human Rights, the Association for Legal Intervention, the Jesuit Refugee Service Poland Foundation, the Ocalenie Foundation, the Polish Migration Forum Foundation, the Polish Humanitarian Action, and Save the Children Poland.

 

We firmly believe that our collective perspective can contribute to the development of more effective, humane, and sustainable solutions that better address the specific needs of migrants while adhering to international standards and human rights principles.

These recommendations do not exhaust the broad scope of issues related to the implementation of the pact. They cannot replace the inclusion of experts from social organizations in this process or the need for formal public consultations.
